Update on Ontario Land Tribunal Case Regarding Proposed Subdivision Issues

A settlement has been reached through the Ontario Land Tribunal (OLT) led mediation process concerning the proposed subdivision by CAIVAN (Perth GC) Limited (Case Number OLT-23000534).

Mediation sessions have taken place throughout the year, and have brought together representatives from the Town of Perth, County of Lanark, CAIVAN, legal counsel, expert witnesses, and the Tribunal-appointed mediator. Sessions were held on February 14, March 16, April 30, May 30, August 19, September 23, and October 23. These sessions allowed all parties to present information, clarify issues, and work through areas of agreement and disagreement under the guidance of the Tribunal-appointment mediator.

Next Steps in the OLT Process

Over the coming weeks, the following steps will occur as part of the Tribunal process;

• Drafting of the Minutes of Settlement: Legal counsel for the parties are preparing the Minutes of Settlement.
• Review and Approval: Once received, the Minutes of Settlement will be reviewed and signed by the Town of Perth, Lanark County, and CAIVAN.
• Public Posting: After all approvals are complete, the Minutes of Settlement will be posted for public access.
• Public Meeting: A Public Meeting will be held to present the settlement details and give interested parties an opportunity to learn more. The date and location are to be confirmed, with an anticipated timeframe as early as January 2026. Details will be shared as soon as they are finalized.
• Participant Submissions: Participants in the Tribunal process will have the opportunity to update or withdraw their previous statements. The OLT will provide the date and mechanism for this step.
• OLT Hearing: A hearing will be held to review the Minutes of Settlement and participant statements, and for the OLT to render their final decision. The hearing date is to be determined by the OLT.

The Town understands that residents have been closely following this matter. While the information that can be shared by Town staff and Council is limited due to active OLT proceedings, the Town remains committed to transparency. Once the Minutes of Settlement have been approved by all required parties, full details will be shared on Engage.Perth.ca/Caivan and at the Public Meeting.
